1. Services Provided

AlertPaw offers personalized emergency identification tags and cards designed for pets and pet owners, along with various tools to assist in emergencies. Our products and services are meant to facilitate communication in case of emergencies, but they are not intended to replace professional medical or veterinary advice.

2. No Liability for Pet Health or Well-being

AlertPaw does not assume any responsibility for the health, safety, or well-being of your pet. AlertPaw's alert service is not automatically activated in an emergency situation. Alert activation is a manual process. Pet health and care remain the sole responsibility of the pet owner, and AlertPaw is not liable for any injuries, illness, or harm that may come to your pet, regardless of whether it arises in connection with our services.

3. Third-Party Tools and Services

AlertPaw may utilize third-party services, including messaging platforms, email systems, or other tools, to assist in delivering certain functionalities, such as emergency notifications or communications with pet care providers. While we make efforts to ensure these services operate smoothly, we cannot guarantee their availability or reliability. We are not responsible for any failures, outages, or interruptions in these third-party services that may affect your use of our products or services.

4. Shipping and Delivery

While we strive to fulfill all orders promptly, AlertPaw is not responsible for any issues related to the shipping or delivery of products, including but not limited to delays, damages, or lost shipments. Once products are handed over to the carrier, AlertPaw’s responsibility ends. Customers are advised to track their orders and address any shipping concerns directly with the carrier.

5. Referral and Third-Party Providers

AlertPaw may, from time to time, refer customers to third-party providers or services that we believe may be helpful, such as veterinary clinics, emergency pet care providers, or other pet-related services. However, AlertPaw is not responsible for the services provided by these third parties, and any agreements or interactions with them are solely between the customer and the third-party provider. We do not guarantee the quality or reliability of any third-party service, and AlertPaw will not be held liable for any disputes, issues, or dissatisfaction that may arise from these services.

6. Intellectual Property

All intellectual property (IP) rights related to the services, products, and content provided by AlertPaw, including but not limited to designs, logos, text, graphics, software, processes, methodologies, educational materials, training content, user interfaces, and other materials, are owned exclusively by AlertPaw or our licensors. You agree not to use, copy, distribute, modify, or create derivative works based on any part of AlertPaw’s IP without prior written consent from AlertPaw.

7. Data Storage and Privacy

AlertPaw respects your privacy and complies with all applicable governmental laws and regulations regarding the collection, storage, and handling of your information. We may collect and store certain personal information in order to provide our services. This information will be handled in accordance with our Privacy Policy, which outlines how we protect your data and what we do with it. By using our services, you consent to the collection and use of your data in accordance with these policies. You also acknowledge and agree that AlertPaw is not responsible for the actions or failures of third-party services or platforms we may use in storing or processing information.

8. Limitation of Liability

In no event shall AlertPaw be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of our products or services, including any damages related to shipping, third-party services, or pet health. Furthermore, in no event shall the total liability of AlertPaw exceed the total amount paid by the customer for their subscription or service purchase during the 12-month period preceding the claim.

9. Dispute Resolution and Jurisdiction

Any dispute, claim, or legal action arising from or related to these Terms and Conditions, the use of our services, or any other matter involving AlertPaw must be pursued in the jurisdiction of our choosing, and by using our services, you agree to this exclusive jurisdiction. We encourage customers to address any issues directly with AlertPaw as soon as they arise, as we are committed to resolving disputes in a fair and timely manner.Before pursuing any legal action, both parties agree to first attempt to resolve the dispute through binding arbitration. Arbitration must be conducted in accordance with the rules of the jurisdiction chosen by AlertPaw, and any arbitration award will be binding. You waive the right to pursue any claims in a court of law, except for claims seeking injunctive relief or other forms of equitable relief.

10. Modification of Terms

AlertPaw reserves the right to update or modify these Terms and Conditions at any time. All changes will be posted on our website, and it is your responsibility to review these terms periodically. Continued use of our services after any changes constitutes your acceptance of the updated terms.

11. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which AlertPaw is registered, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.
